These Terms and Conditions govern the use of Gymogy by individual members, trainers, gym operators, staff, delegates, and buyers of digital subscriptions or related services processed through the platform.
Gymogy is software for fitness operations, member management, coaching workflows, analytics, subscriptions, packages, quotas, messaging, and related administrative tasks. Gymogy is not a medical provider, insurer, emergency service, or guarantor of trainer or gym performance.
1. Acceptance And Contract Scope
By creating an account, activating a trial, purchasing a plan, or using any protected Gymogy feature, you agree to these terms, the Privacy Policy, the Cookie Policy, and any product-specific commercial or refund rules published at the time of use or purchase. If you do not agree, do not use Gymogy.
Some services on Gymogy are provided directly by the Gymogy operator, while some underlying training, gym, or offline services are provided by independent gyms, trainers, or other businesses using Gymogy. Those independent sellers remain responsible for the real-world service they supply, even when Gymogy provides the software workflow around it.
2. Eligibility, Minors, And Authority
You may only use Gymogy if you have the legal capacity to agree to these terms or are using the service through a parent, guardian, employer, institution, or other authorized arrangement that can lawfully bind the account holder or business.
If you create or manage a gym, trainer, staff, or delegate account, you represent that you are authorized to act for that account and to submit the business, tax, contact, pricing, and staff-access information you provide.
3. Accounts, Roles, And Access Control
You must keep account information accurate, keep login credentials confidential, and immediately report unauthorized use. Gymogy may rely on the latest role, delegation, subscription, or relationship state shown in the system when deciding what features, billing controls, or data access you are allowed to use.
If Gymogy grants access through inheritance, assignment, trial, admin grant, or bundle logic, the highest-priority valid entitlement may control feature access. Inherited access does not automatically give billing authority over the underlying owner account.
- Do not share credentials outside the authorized business or household context permitted by your role.
- Do not misrepresent your identity, authority, certifications, or insurance status.
- You are responsible for actions taken from your account unless caused solely by Gymogy system fault after you have taken reasonable security steps.
4. Health, Safety, And Professional Disclaimer
Gymogy may display workout plans, exercise libraries, progress charts, body metrics, fatigue indicators, AI-assisted suggestions, or coach-entered notes. None of these are a diagnosis, prescription, or emergency-care substitute. You must use independent judgment and obtain professional medical guidance where appropriate.
Trainers and gyms using Gymogy are independent professionals or businesses. Gymogy does not guarantee their qualifications, safety practices, insurance coverage, pricing decisions, or the outcomes of their coaching or facility services.
5. Privacy, Cookies, Consent, And Data Boundaries
Use of Gymogy is subject to the Privacy Policy, the Cookie Policy for browser-based surfaces, and the platform consent engine. Member-facing data may be shown, masked, withheld, or revoked according to consent state, role permissions, relationship state, subscription entitlements, and lawful override logic.
If you are a trainer, gym, or business user, you must not treat Gymogy access as permission to use member data for unrelated marketing, external resale, or uncontrolled exports. You remain responsible for your own off-platform data handling where you independently collect or process customer data.
6. Plans, Trials, Subscriptions, Quotas, And Packages
Gymogy may offer free plans, trials, recurring subscriptions, one-time plan purchases, add-on quotas, package assignments, delegated access, admin grants, or bundled entitlements. Feature access may change automatically when a higher-priority plan activates, a lower-priority plan is paused, a trial expires, a quota is consumed, or an assignment is revoked.
Trial access, quota allocation, client caps, and seat usage are governed by the plan, package, product, or assignment rules shown in the product at the time of activation. Gymogy may suspend, downgrade, or limit access when payment, abuse, entitlement, or compliance conditions require it.
7. Billing, Recurring Charges, And Payment Rules
Paid features are billed in the currency and amount shown at checkout, subject to taxes, mandate authorization, provider terms, bank rules, and product-specific pricing. Where recurring billing is enabled, you authorize the payment provider and relevant banking rails to charge the approved amount according to the mandate or recurring instructions you confirm.
Gymogy may rely on provider responses such as authorized, active, pending, halted, failed, past-due, or canceled when updating service access. A payment-provider delay or bank rejection may temporarily interrupt features even if a local screen has not refreshed yet.
- Gymogy does not promise uninterrupted access during failed, halted, reversed, disputed, or overdue payment states.
- Where required by payment rules, provider or bank workflows may require pre-debit notices, re-authentication, or mandate renewal before a recurring charge completes.
- Charges from independent gyms or trainers using Gymogy may be subject to their own local commercial terms in addition to these platform terms.
8. Refunds, Freezes, Cancellations, And Disputes
Refund, freeze, and cancellation outcomes are governed by the Commerce, Refund & Freeze Policy, the applicable plan or package rules, the extent of service or quota already used, and any recorded override reason. Refund eligibility is not determined solely by a button click or account-cancellation request.
If you dispute a charge, request a freeze, or seek a refund, Gymogy may require order references, timestamps, usage evidence, duplicate-charge details, account state, or provider references before a decision is made. Fraudulent, abusive, or serially manipulated claims may be denied.
9. Acceptable Use And Restricted Conduct
You may not use Gymogy to break the law, mislead users, evade plan limits, misuse consented data, interfere with service operations, scrape protected content, reverse engineer security measures, upload malicious files, spam users, or create unsafe or abusive experiences for members, staff, trainers, or gyms.
- No credential stuffing, bot abuse, unauthorized automation, or data harvesting.
- No fake certifications, fake reviews, or impersonation of another user, trainer, gym, or business.
- No circumvention of subscription, quota, freeze, refund, or moderation controls.
10. Intellectual Property, Feedback, And User Content
Gymogy and its licensors own the software, designs, trademarks, interfaces, and non-user content delivered by the platform. You retain rights in the data and content you upload, but you grant Gymogy a limited, non-exclusive right to host, process, display, index, back up, and transmit that content as needed to operate the service and comply with law.
If you submit feedback, bug reports, feature requests, or workflow suggestions, Gymogy may use that feedback without owing compensation, provided Gymogy does not claim ownership of your unrelated business or personal confidential information.
11. Suspension, Availability, And Enforcement
Gymogy may modify, suspend, or stop features for maintenance, legal compliance, abuse prevention, provider dependencies, plan changes, or security reasons. Gymogy may also suspend accounts or features immediately where fraud, payment failure, safety risk, data misuse, or legal exposure requires it.
Where commercially reasonable, Gymogy will try to preserve access to exported records, audit history, or support resolution artifacts, but it is not required to preserve every live feature or every deleted item indefinitely.
12. Liability And Indemnity
To the maximum extent permitted by law, Gymogy is not liable for indirect, incidental, punitive, special, or consequential loss, including lost profits, lost business opportunity, lost goodwill, loss caused by unauthorized third-party conduct, or outcomes of offline coaching or gym services delivered by independent sellers.
Where the law allows a liability cap, Gymogy's aggregate liability for claims arising from the service will not exceed the fees paid to the Gymogy operator for the affected service during the 12 months immediately preceding the claim. This cap does not override rights that cannot lawfully be waived under Indian consumer or data-protection law.
13. Governing Law And Jurisdiction
These terms are governed by the laws of India. Subject to any mandatory consumer-forum rights that cannot be excluded by law, the courts and competent forums at Chennai, Tamil Nadu will have exclusive jurisdiction over disputes arising from or connected with Gymogy or these terms.
